Privacy Policy

Martial Solutions LLC ("Company," "we," "us," or "our") operates martialsol.com and the MartialSol AI Receptionist Service (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect information about you when you use our website or Service.

By using the Service, you agree to the collection and use of information in accordance with this policy.

1. Information We Collect

1.1 Information You Provide

When you register for or use our Service, we may collect:

  • Account information: Business name, owner name, email address, phone number, physical address, industry/vertical, and password.
  • Payment information: Billing name, billing address, and payment card details. Payment card data is processed directly by Stripe, Inc. and is never stored on our servers.
  • Onboarding data: Business services, operating hours, team size, FAQs, booking preferences, and any information provided during onboarding (including via The Architect voice onboarding system).
  • Support communications: Messages, emails, or other content you send us when requesting support.

1.2 Information Collected Automatically

When you visit our website or use the Service, we automatically collect:

  • Usage data: Pages visited, features used, time and date of access, referring URLs, and click-through behavior.
  • Device and log data: IP address, browser type and version, operating system, device identifiers, and error logs.
  • Cookies and tracking technologies: We use cookies and similar technologies to maintain sessions, remember preferences, and analyze usage. See Section 8 for details.

1.3 Call and Communication Data

As part of the Service, our AI receptionist answers phone calls, sends SMS messages, and books appointments on behalf of our clients ("Client Businesses"). In doing so, we may process:

  • Call recordings and transcripts: Inbound and outbound calls handled by the AI are recorded and transcribed to deliver the Service and improve AI performance.
  • Caller information: Names, phone numbers, appointment details, and messages left by callers contacting Client Businesses through our system.
  • SMS and messaging content: Content of automated SMS messages sent on behalf of Client Businesses.
Note: If you are an individual who called a business using our AI receptionist and did not provide information directly to us, your data was collected on behalf of the Client Business. Please contact that business for more information or to exercise your rights.

2. How We Use Your Information

We use the information we collect to:

  • Provide and operate the Service: Process signups, provision AI agent sub-accounts, route calls, send appointment reminders, and deliver all contracted features.
  • Process payments: Charge subscription fees and manage billing through Stripe.
  • Communicate with you: Send onboarding emails, support responses, billing notifications, product updates, and service announcements.
  • Improve the Service: Analyze usage patterns, debug issues, train and fine-tune AI models, and develop new features.
  • Ensure security and compliance: Detect fraud, enforce our Terms of Service, and comply with legal obligations.
  • Marketing (with consent): If you opt in, we may send promotional communications about our products and services. You may opt out at any time.

3. How We Share Your Information

We do not sell your personal information. We may share information with:

All subprocessors are contractually required to handle data only per our instructions and applicable data protection laws.

3.2 Business Clients

If you are an end user (i.e., a caller or customer of a Client Business), your call data and appointment information are shared with the applicable Client Business. Client Businesses are responsible for their own privacy practices regarding their customer data.

3.3 Legal Requirements

We may disclose information if required by law, subpoena, court order, or other legal process, or when we believe in good faith that disclosure is necessary to protect the rights, property, or safety of our company, users, or the public.

3.4 Business Transfers

In connection with a merger, acquisition, asset sale, or similar transaction, your information may be transferred as a business asset. We will notify you before your information becomes subject to a different privacy policy.

4. Call Recording Disclosure

All calls handled by the MartialSol AI Receptionist system are recorded. By calling a phone number powered by MartialSol, or by subscribing to the Service for your business, you acknowledge and consent to call recording. Client Businesses are responsible for providing any required call-recording disclosures to their customers as required by applicable state or local law.

5. Data Security

We implement industry-standard technical and organizational measures to protect your information, including TLS/SSL encryption for data in transit, encrypted storage for data at rest, access controls limiting data access to authorized personnel, and regular security reviews and monitoring.

No method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security but are committed to protecting your data using commercially reasonable means.

6. Data Retention

We retain personal information for as long as necessary to provide the Service and fulfill the purposes described in this policy:

  • Account data: Retained for the duration of your subscription plus 90 days after termination, then deleted or anonymized.
  • Call recordings and transcripts: Retained for 12 months by default. Growth and Enterprise clients may configure custom retention windows.
  • Payment records: Retained for 7 years to comply with financial and tax recordkeeping requirements.
  • Marketing data: Retained until you unsubscribe or request deletion.

7. Your Rights and Choices

Depending on your location, you may have the following rights:

  • Access: Request a copy of the personal information we hold about you.
  • Correction: Request correction of inaccurate or incomplete information.
  • Deletion: Request deletion of your personal information, subject to legal retention obligations.
  • Portability: Request your data in a machine-readable format.
  • Objection/Restriction: Object to or request restriction of certain processing activities.
  • Opt out of marketing: Unsubscribe via any marketing email or contact us directly.

California Residents (CCPA/CPRA): You have the right to know what personal information is collected, the right to delete, the right to opt out of sale (we do not sell personal information), and the right to non-discrimination for exercising these rights.

8. Cookies and Tracking Technologies

We use cookies for strictly necessary functions (login sessions, core functionality), analytics (understanding how visitors use our site), and marketing (tracking campaign effectiveness, only with opt-in). You can control cookies through your browser settings. Disabling cookies may affect certain features.

9. Children's Privacy

The Service is intended for business owners 18 years of age or older. We do not knowingly collect personal information from children under 13. If we become aware that we have collected such information, we will delete it promptly.

10. International Data Transfers

Our services are operated in the United States. If you access our Service from outside the United States, your information may be transferred to, stored, and processed in the United States. By using the Service, you consent to such transfer.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on martialsol.com with a new effective date and sending an email notification to your registered address. Continued use of the Service after changes constitutes acceptance of the updated policy.
